In Australia a person may trade under a trading name which is registered (as a business name) in the State or Territory in which such business is conducted. Alternatively, trade may be conducted using a corporation incorporated or registered under Australian law. Business or corporate names are registered independently from any trade mark registration, but unlike a trade mark registration, do not confer statutory rights of a proprietary nature, i.e. ownership, to the name. Disputes often arise between conflicting business names and trade marks.
